en adelante Contrato, celebrado entre Drivalia Car Rental, S.L. con CIF nº B-54509971 y domicilio social en Ctra. Murcia-Alicante, km. 26,800, 03300, Orihuela (Alicante) en adelante Drivalia (también llamado arrendador) y el Arrendatario, cuyos datos identificativos quedan recogidos en el anverso del Contrato, (en adelante el arrendatario).
1. OBJETO DEL CONTRATO
Drivalia entrega al arrendatario en alquiler el vehículo descrito en el correspondiente contrato firmado por el mismo, en perfectas condiciones de funcionamiento, con todos sus documentos, neumáticos, herramientas y accesorios así como en buen estado general exterior y de limpieza.
El arrendatario se compromete expresa pero no exclusivamente a:
2. CAUCION / DEPOSITO O FIANZA
En el momento de la firma del contrato, el arrendatario abonará a Drivalia, además del importe de la liquidación del contrato correspondiente, una cantidad de hasta 3000 Euros, dependiendo del modelo del vehículo, en concepto de caución / depósito o fianza. La fianza exacta aplicable a cada alquiler viene reflejada en el anverso, indicado como “Excess xxxx euros”.
El depósito sólo se aceptará mediante bloqueo o cobro contra una o dos tarjetas de crédito VISA o MASTERCARD que obligatoriamente deberán figurar a nombre del arrendatario.
En caso de que dicha cantidad depositada en fianza no cubra en su totalidad los posibles cargos adicionales que pudieran generarse por incumplimiento de alguna de las condiciones y/o exclusiones de las coberturas de accidente y robo, el arrendatario deberá abonar al arrendador la diferencia y autoriza al arrendador a efectuar cargos posteriores tal y como se menciona en el punto 4.1.
En caso de no producirse ningún cargo extra, el arrendador desbloqueará o devolverá, según proceda, dicho depósito al arrendatario una vez finalizado el contrato, en un plazo máximo de tres (3) días laborales.
3. DEVOLUCION DEL VEHICULO
El vehículo se devolverá en el lugar, fecha y hora estipulados en el contrato y en el mismo estado en que se entregó por el arrendador, con todos sus documentos, neumáticos, llaves, herramientas y accesorios. Cualquier alteración en las condiciones de devolución pactadas podrá repercutir en cargos adicionales para el arrendatario.
La duración del contrato de alquiler no podrá exceder en ningún caso más de 30 días.
En caso de finalización anticipada del contrato por decisión del arrendatario, este no tendrá derecho a la devolución de los días no disfrutados del alquiler.
Existe un margen de cortesía de 59 minutos de retraso en la devolución del vehículo con respecto a la hora pactada, por lo que si el mismo se devuelve fuera de ese margen el arrendatario abonará un importe extra correspondiente como mínimo a un día de alquiler. El importe final por este motivo, quedará supeditado al momento de la devolución del vehículo.
En caso de que el arrendatario quiera prolongar en el tiempo el alquiler de su vehículo debe comunicarlo con la suficiente antelación al arrendador, firmar en el momento un nuevo contrato de los días prolongados y abonar un nuevo importe de forma inmediata para la cobertura de ese nuevo servicio, no garantizando el arrendador que dicha prolongación pueda efectuarse.
En caso de que la devolución del vehículo no se realizase en el lugar, fecha y hora estipulada en el contrato, esto facultaría a Drivalia Car Rental a cobrar el importe correspondiente a los días adicionales por el retraso además del pago de 35 euros en concepto de penalización por los perjuicios económicos ocasionados así como cualquier gasto derivado de la repatriación y/o recuperación del vehículo. Queda expresamente prohibido la devolución del vehículo en las terminales aeroportuarias de Salidas / Departures.
El incumplimiento de esta condición faculta al arrendador a hacerse cargo del vehículo sin previo aviso o requerirlo judicialmente.
Con el fin de garantizar la reciprocidad en el contrato, el arrendador se compromete a indemnizar al arrendatario el importe de 35 euros en concepto de entrega con retraso, en el supuesto de que no esté el vehículo disponible en la fecha y hora pactada de entrega en el presente contrato.
4. CARGOS POR ALQUILER Y FORMAS DE PAGO.
4.1 Cargos por alquiler
El arrendatario está de acuerdo en que Drivalia realice con posterioridad a la finalización del alquiler del vehículo, por medio de sistemas de pago electrónicos o de cualquier otro sistema de cobro, sin su autorización expresa, cargos por los siguientes conceptos:
El importe del cargo que se efectúe al arrendatario por los daños causados al vehículo, se calculará teniendo en cuenta la tasación realizada por gabinete pericial externo a Drivalia, o cuando no pueda realizarse a priori dicha cuantificación, se cargará la cuantía que resulte de una primera valoración realizada por personal cualificado de Drivalia según tarifa de precios publicada en la web www.drivalia.com y que están a disposición en la oficina de recogida del vehículo, cuya existencia e importes declara conocer el arrendatario, estando conforme con los mismos.
Todo lo anterior es de aplicación sin perjuicio de una posterior liquidación y ajuste, una vez obtenido un presupuesto de reparación realizado por un taller o una tasación realizada por un gabinete pericial, externo a Drivalia.
Drivalia se reserva así mismo la potestad de cobrar al arrendatario una indemnización por la pérdida de beneficios por la inmovilización del vehículo como consecuencia de los daños sufridos (paralización). Dicha indemnización será calculada sobre el número de días que sea necesario invertir en la reparación del vehículo, establecidos por perito externo a Drivalia o, una vez realizada la reparación, computando un día por cada ocho horas de trabajo invertidas por el taller reparador y utilizado como base de cuantificación la tarifa diaria de ocupación contratada.
En cualquier caso, la responsabilidad máxima del arrendatario será siempre el valor del vehículo en el mercado, según el precio máximo establecido en la guía Ganvam vigente en el momento del accidente.
4.2 Forma de pago
Por motivos de seguridad, únicamente se aceptará el pago mediante tarjeta de crédito VISA o MASTERCARD. La tarjeta de crédito debe estar a nombre de la persona que figure como titular del contrato de alquiler.
De forma excepcional, únicamente se aceptará el pago mediante tarjeta de débito para los arrendamientos contratados con tarifa Ultimate.
El pago del alquiler del vehículo y de los diferentes conceptos adicionales se efectuará en la moneda elegida por el arrendatario, aceptándose las operaciones en multidivisa, con sujeción a las condiciones de la Entidad Bancaria que gestiona el pago.
5. SEGUROS Y COBERTURAS
En la liquidación de los contratos se incluye el pago de las coberturas del seguro obligatorio del automóvil y de responsabilidad civil ilimitada. Estas coberturas quedan garantizadas y se asumen por el asegurador con el que el arrendador tiene concertada la correspondiente póliza de seguro, quedando el arrendatario y conductores autorizados, mediante la firma de este contrato, adheridos como asegurados a dicha póliza.
No se consideran terceras personas a efectos del seguro el cónyuge, ascendientes, descendientes y hermanos o parientes del arrendatario o conductores autorizados, así como sus socios o personas que tengan con los mismos relación mercantil, laboral o de dependencia.
5.1. Cobertura por accidente:
Exime al arrendatario (salvo el importe de la franquicia, la paralización y del cargo por gestión de accidentes) de la responsabilidad económica y civil por daños producidos al vehículo.

Exime al arrendatario (salvo el importe de la franquicia y la paralización) de la responsabilidad económica y civil por la pérdida total o parcial del vehículo por actos de vandalismo o incendio fortuito y espontáneo del mismo.
Exenciones expresas de la cobertura de robo e incendio:
5.3. Franquicia:
Se establece en el presente contrato una franquicia de hasta 3.000 Euros, dependiendo del grupo de vehículo, a cargo del arrendatario. El arrendador podrá exigir al arrendatario, en el momento de la formalización de este contrato, el depósito de una cantidad de hasta 3.000 Euros, no eximible, en concepto de franquicia, hasta la cual el arrendatario soportará los daños y/o pérdidas ocasionado/as al vehículo no cubiertos en la cobertura por accidente ni en la de por robo o incendio. El importe exacto de franquicia aplicable a cada alquiler particular vendrá reflejada en el anverso como “Excess xxxx Euros”.
En cualquier caso, si el arrendador no ha exigido el pago por adelantado de la franquicia, el arrendatario acepta expresamente con la firma de este contrato que asumirá cualquier cargo extra hasta el importe de la franquicia.
En caso de no producirse ningún daño y/o pérdida o, de producirse, se documente la responsabilidad de un tercero y exista aceptación firme o resolución judicial en perjuicio de ese tercero, el arrendador devolverá dicha franquicia, cuando éste la haya cobrado por adelantado, al arrendatario una vez finalizado el contrato.
5.4. Suplemento del Seguro y exención de Franquicia:
El arrendatario podrá liberarse del pago de la franquicia de hasta 3.000 Euros, del cargo por gestión de accidentes y de otras exclusiones del seguro ordinario, contratando y abonando, de forma opcional, el suplemento especial de la cobertura “Premium”, el S.C.D.W (Cobertura de Colisión) o la tarifa Ultimate, cuya contratación e importe figurará expresamente en el contrato. Dicha cobertura no podrá ser adquirido con posterioridad al inicio del contrato. Si no figura en el contrato el abono de alguno de las coberturas adicionales, se entenderá que no está contratado y el arrendatario asume expresamente toda la responsabilidad por los daños excluidos en estas condiciones generales. Una vez contratada esta cobertura no podrá ser cancelada anticipadamente ni se aplicarán devoluciones económicas por este concepto.
6. ACCIDENTES
El arrendatario se compromete a informar a Drivalia en un plazo máximo de cuarenta y ocho horas de cualquier siniestro y a transmitirle cuantas notificaciones se refieran a dicho siniestro aportando el correspondiente parte de accidente o datos completos de la parte contraria y posibles testigos.
El arrendatario no deberá prejuzgar ni reconocerá la responsabilidad del hecho, recogerá todos los datos posibles y notificará a las autoridades si existe culpabilidad de la parte contraria.
El arrendatario no abandonará el vehículo en la vía pública tomando siempre las medidas adecuadas para protegerle.
En caso de accidente, indistintamente del causante de dicho accidente, y salvo que se haya contratado la cobertura “Premium”, el S.C.D.W (Cobertura de Colisión) o tenga contratada la tarifa Ultimate, el arrendador cobrará al arrendatario un cargo por gestiones administrativas de accidentes por importe de 60€.
7. REPARACIONES
En caso de avería mecánica las oficinas de Drivalia disponen de los teléfonos de asistencia propios de cada marca de vehículo a los cuales deberá acudir el arrendatario en caso de no poder conducir el mismo hasta un taller cercano para el reconocimiento de la avería o hasta la oficina de Drivalia más próxima.
Si el vehículo ha de ser reparado el arrendatario deberá informar a Drivalia de la avería y de su coste a fin de que el arrendador autorice por escrito la reparación en ese taller o decida repararlo en un taller concertado del arrendador.
El arrendatario deberá comprobar el nivel de líquidos y reponerlos si es necesario.
Los costes de reparaciones autorizadas o reposición de líquidos que hayan sido abonados por el arrendatario le serán devueltos por el arrendador, excepto pinchazos, contra presentación de los recibos correspondientes salvo que dicha avería haya sido causada por negligencia o mal uso del vehículo por el arrendatario, debiendo en este caso abonar dichos gastos mas los gastos de desplazamiento, remolque y paralización del vehículo, o si dicha reparación no ha sido autorizada por el arrendador.
8. COMBUSTIBLE
Es responsabilidad del arrendatario repostar el vehículo con el tipo de combustible adecuado, cuyo importe será siempre a su cargo. Cualquier gasto o reparación derivado por uso de combustible inadecuado será a cargo del arrendatario.
El vehículo deberá ser devuelto al menos con la cantidad de combustible en el tanque que figure en la casilla del apartado “devolución”. Si no fuese así, el arrendatario deberá bonar la cantidad de combustible faltante al precio vigente en ese momento.
El arrendador comercializa varios tipos de tarifas con tres (3) diferentes políticas de combustible (“Lleno-Vacío”, “Lleno- Vacio con reembolso”, “Lleno – Lleno”), el arrendatario acepta expresamente, y conoce de antemano, la política de combustible en función de la tarifa que escoge.
9. CARGOS EXTRAS
La liquidación o importe total final del alquiler queda supeditada a que la devolución del vehículo se realice en las mismas condiciones en que fue entregado y en la fecha, hora y lugar previstos, por lo que el arrendatario, deberá abonar al arrendador, una vez devuelto el vehículo, cualquier cargo extra ocasionado imputable a dicho arrendatario en base a estas condiciones generales.
10. ROBOS, DAÑOS Y PERDIDAS DE OBJETOS PERSONALES.
En ningún caso Drivalia se hará responsable de los objetos robados, dañados, olvidados o perdidos en el interior de vehículo.
11. DISPOSITIVOS DE RETENCION PARA NIÑOS.
Drivalia dispone de dispositivos homologados de retención para niños que podrán ser suministrados a los clientes que lo soliciten previo pago de la tarifa de alquiler. La instalación del mismo será únicamente responsabilidad del arrendatario. En caso de no devolución, pérdida o robo se le cobrará al arrendador la cantidad de 45€ por los dispositivos conocidos como “booster / elevador” y/o 95€ por los dispositivos conocidos como “Baby Seat”.
12. CANCELACION DEL CONTRATO.
Drivalia se reserva el derecho de resolver este contrato anticipadamente con carácter inminente y sin ningún tipo de indemnización en cualquiera de estos casos:
- si se produce el impago del contrato.
- cuando el arrendatario este haciendo un uso no autorizado del vehículo.

14. JURISDICCION Y LEY APLICABLE
El presente contrato se regirá por las leyes españolas y, para el caso de que el arrendatario merezca la consideración de consumidor o usuario, cualquier discrepancia se someterá a la jurisdicción correspondiente al lugar del cumplimiento de la obligación, teniendo dicha consideración la del lugar donde se inició el alquiler, y todo ello conforme a lo expresamente establecido en la normativa vigente en materia de consumidores y usuarios.
No obstante, lo anterior, y conforme a lo expresamente establecido en el artículo 38 de la ley 16/1987, de 30 de Julio, de Ordenación de los Transportes Terrestres, DRIVALIA, manifiesta expresamente su voluntad en contra de que la resolución de cualquier controversia suscitada como consecuencia de la contratación de los servicios de arrendamientos de vehículos, sea resuelta a través de la Junta arbitral de Transporte.
15. DISPOSICION ADICIONAL
Es responsabilidad del arrendador leer este contrato detenidamente; cualquier duda o disconformidad deberá hacerla constar antes de aceptar y/o firmar el contrato.
En caso de incumplimiento de cualquiera de estas cláusulas, la parte arrendataria asume toda la responsabilidad en cuanto a daños y perjuicios que pudiera ocasionar dicho incumplimiento tanto al arrendador como a terceros.

GENERAL CONDITIONS OF HIRING: hereinafter the Contract, executed between DRIVALIA ESPAÑA S.L.U. holding CIF [Spanish Tax Code Number] B-54509971 and with registered office in Calle Arquitecto Urteaga 21, Local C 03730 JÁVEA (Alicante) - España hereinafter Drivalia (also known as the lessor) and the Lessee, whose identification data is included on the front page of the Contract, (hereinafter the lessee).
1. CONTRACT SUBJECT MATTER
Drivalia rents the car specified in the contract to the lessee which they sign. The car is in perfect working order, with all its documents, tyres, tools and accessories, as well as being in a good general external condition and clean.

2. SECURITY / DEPOSIT OR DOWN PAYMENT
When signing the contract, the lessee will pay Drivalia the corresponding settlement price of the contract as well as an amount of up to €3.000, depending on the model of the car, as a security / deposit or down payment. Deposits will only be accepted by reservation or charge against one or two VISA or MASTERCARD credit cards that must be in the lessee's name. The deposit amount and excess applicable will be shown on the contract as "Excess XXXX €"
If the said deposited amount does not fully cover the possible additional charges that may arise from a breach of any of the conditions and/or accident or theft coverage exclusions, the lessee should pay the lessor the difference and authorise the lessor to make the subsequent charges as stated in point 4.1.
If no extra charges are made, the lessor will release or return, as appropriate, said deposit to the lessee once the contract has expired, within three (3) working days.
For those who purchase Drivalia direct Premium Coverage, S.C.D.W. (Super Collision Damage Waiver) or Ultimate Rate clause 2 will not apply and there will usually be no deposit required although we reserve the right to request a deposit at our sole discretion under any circumstances.
3. RETURNING THE VEHICLE
The vehicle will be returned to the place, on the date and at the time stipulated in the contract. It will be returned in the same condition in which it was handed over to the lessee, with all its documents, tyres, keys, tools and accessories. Any changes to the conditions of return agreed upon may result in the lessee paying extra charges.
The duration of the rental contract shall never exceed 30 days.
If the contract is terminated early, by decision of the lessee, they will not be entitled to a refund for the days of rental not used.
An extra 59 minutes is given for the return of the vehicle, in accordance to the hour agreed on. Therefore, if it is returned after this time, the lessee will pay the extra amount corresponding to a minimum of one day's rental. For this reason, the final amount will depend on the time the vehicle is returned.
If the lessee wishes to extend the rental time of their vehicle, they should give sufficient notice to the lessor, sign a new contract for the extra days at the time such decision is made and immediately pay the new amount to cover this new service. The lessor does not guarantee that said extension can be carried out.
If the vehicle is not returned to the place, at the hour and on the date stipulated in the contract, this will entitle Drivalia to charge the amount corresponding to the extra days for the delay. Furthermore, a penalty fee of €35 will be charged for the financial losses caused, as well as any cost resulting from the vehicles repatriation and/or recovery. It is expressly forbidden to return the vehicle to the airport Departure terminals.
A failure to comply with this condition entitles the lessor to take back the vehicle without notice or to claim it back by means of legal action.
4. RENTAL CHARGES & PAYMENT METHODS.
4.1 Rental charges
The lessee agrees to Drivalia carrying out charges, after the vehicle rental has terminated, via electronic payment systems or any other charging system and without express authorisation, for the following purposes:
a) An "extra cleaning" charge for the costs arising from an extra cleaning service as a consequence of the clearly inadequate state of the vehicle at the time of its return. Furthermore, the vehicle will be considered to be in a poor condition if there are upholstery stains, including those produced by salt residue and excessive amounts of sand, and a surcharge of up to €180 will be apply.
b) As a result of the loss of the vehicles documents and keys, and/or the delivery of the vehicles set of keys to the corresponding office, loss or breakage, returning the keys of the vehicle to a different office to which the vehicle was returned, or any other situation for which the vehicle is out of service, for reasons directly attributable to the lessee, a maximum of €250 will be charged.
c) The amount for towing the vehicle when necessary, unless this is due to mechanical reasons except for those due to negligence or which arise from the lessee misusing the vehicle.
d) 100% of the costs resulting from the loss or damage to the rims, hubcaps, tyres (including punctures), tools, windscreens and windows, rear view mirrors, clutch, accessories, the vehicle's interior, as well as problems resulting from filling up the tank with the wrong fuel.
e) 100% of the costs resulting from damages made to the lower part of the bodywork, including the lower wings/mud flaps.
f) The toll roads, fines, penalisations and legal costs arising from traffic offences or breaches of law, regulations or bylaws, (including congestion or road traffic limitation charges wherever they exist), incurred by the client during the period of this Contract, that have been paid for by Drivalia.
g) Notwithstanding the foregoing, Drivalia reserves the right to charge the client an additional cost of €35 per file as handling and communication costs before the relevant authorities.
h) 100% of the costs for repairing any damages caused to the vehicle due to an accident, when one of the following circumstances occurs:
o That the vehicle was not used in compliance with the conditions established.
o That the accident report–whether as "Declaracion Amistosa de Accidente" (Mutual Declaration of Accident Report) or whether as a "Informe de Siniestro" (Wreck Report)- has not been completed and sent to Drivalia within the time specified, or it does not correspond to the actual events occurred.
o That the damages are a result of an accident where the lessee did not correctly judge the height and width of the vehicle.
o That the corresponding extra insurance coverage had not been subscribed, (see point 5.4.).
The amount charged to the lessee for the damages to the vehicle will be calculated taking in to consideration the valuation carried out by an expert independent of Drivalia. However, if said valuation cannot be made a priori, the amount resulting from the first assessment made by a qualified member of Drivalia staff will be charged, in accordance with the rates published on www.drivalia.es. The lessee acknowledges the existence of the aforesaid Annex I and costs and accepts them.
All of the above mentioned is to be applied notwithstanding a subsequent settlement, once an estimate for the repair has been received by a mechanic or a valuation made by an expert department independent of Drivalia.
Drivalia reserves the right to charge the lessee compensation for the loss of profits due to the vehicle being out of service as a result of the damages caused (parylisation). This compensation fee will be calculated based on the number of days needed to repair the vehicle, established by an expert department independent of Drivalia, or, once the repairs have been made, counting 8 hours of work done by the garage carrying out the repairs as one day and using the daily rates contracted as a basis for the valuation.
In any case, the lessees' maximum liability will always be the vehicle's market value, according to the maximum price established in the Ganvam (Spanish Association of Car Dealers) guide in force at the time of the accident.
4.2 Payment methods
Payment by VISA or MASTERCARD credit card is the only acceptable method. The card should bear the name of the rental contract holder.
The payment for the rental of the vehicle and for any different additional concepts will be made in the currency determined by the lessee, accepting multi-currency operations, subject to the conditions of the Bank Branch that handles the payment.
5. INSURANCE
In the settlement of the contract, payment for the compulsory insurance coverage of the vehicle and unlimited civil liability is included. Such coverage is guaranteed and assumed by the insurer with whom the lessor has agreed the corresponding insurance policy. The lessee and the authorised drivers are, through the signing of this contract, become policyholders of said policy.
For insurance policy purposes, the spouse, ancestors, descendants and siblings or relatives of the lessee or authorised drivers or their partners or person with whom they have a business, employment or dependant relationship with are not considered third parties.
5.1. Accident Coverage:
This exempts the lessee (except from the deductible cost, being out of service and from the charge related to accident management procedures) from the economic and civil liability for damages caused to the vehicle.
Express exemptions of the accident coverage:
5.2. Coverage for theft or fire:
This exempts the lessee (except from the deductible cost and being out of service) from the economic and civil liability for the total or partial loss of the vehicle due to vandalism or accidental and spontaneous fire.

5.3. Deductible:
A deductible of up to €3,000 charged to the lessee is established in this contract. The lessor may require the lessee, at the time the contract is executed, to deposit an amount of up to €3,000, not eligible for exemption, as a deductible, up to which the lessee shall bear the damages and/or losses caused to the vehicle not covered in the accident coverage or in the coverage for theft or fire.
In any case, if the lessor has not required the deductible payment in advance, the lessee expressly accepts to bear any additional cost up to, at least, €3,000 by signing this contract.
If no damages or losses are made, or in the event they are made and a third party shows evidence of being liable and a court decision has been lodged against thereof, the lessor must return said deductible, when it has been paid in advance, to the lessee once the contract has terminated.
5.4. Insurance Supplement and Deductible exemption:
The lessee shall be exempt from the payment of the deductible for up to €3,000, for the charge related to accident management procedures and from other ordinary insurance exclusions by hiring and paying, optionally, the special supplement of the Premium coverage, S.C.D.W. (Super Collision Damage Waiver) or if the lessee has purchased the Ultimate rate, whose hiring and amount will expressly appear in the contract. Said coverage cannot be purchased after the start of the contract. If the instalment of any of the additional coverage does not appear in the contract, it will be understood to have not been subscribed and the lessee will expressly assume all liability for the damages excluded in these general conditions. Once this coverage has been subscribed it cannot be cancelled in advance and refunds will not be made.
6. ACCIDENTS
The lessee undertakes to inform Drivalia within a maximum period of forty-eight hours about any accident and to provide them with all notifications referring to said accident together with the corresponding accident report or full details of the other party and possible witnesses.
The lessee shall not prejudge or admit responsibility of the accident and shall collect all possible data and notify the authorities if it is the other party's fault.
The lessee will not abandon the vehicle on the public road, taking the appropriate measures to protect the vehicle at all times.
If an accident occurs, regardless of who caused said accident, and unless the Premium coverage has been subscribed, the lessor will charge the lessee for the administrative management procedures of accidents an amount of €60.
If an accident occurs, regardless of who caused said accident, and unless the Premium coverage, S.C.D.W. (Super Collision Damage Waiver) or ULTIMATE rate has been subscribed, the lessor will charge the lessee for the administrative management procedures of accidents an amount of €60.
7. REPAIRS
In case of mechanical breakdown, the offices of Drivalia have the telephone support numbers for each make of vehicle which the lessee can call if they cannot drive the vehicle to the nearest garage in order to repair it or to the nearest Drivalia office.
If the vehicle needs to be repaired, the lessee must notify Drivalia of the breakdown so that the lessor can authorise in writing its repair either in that garage or in one they choose.
The lessee shall also check the fluid levels and refill them, if necessary.
The costs of authorised repairs or fluid refill that have been paid by the lessee shall be returned to them by the lessor, except for punctures, presenting the corresponding receipts, unless said mechanical breakdown has been caused by negligence or misuse of the vehicle by the lessee, in which case the latter must pay the costs together with the displacement, towing and out of service vehicle costs. The same happens if the aforementioned repair has not been authorised by the lessor.
8. FUEL
It is the lessee's responsibility to refuel the vehicle using the appropriate fuel type, the cost of which shall always be at their expense. All costs or repairs resulting from the use of the wrong fuel will also be borne by the lessee.
The vehicle shall be returned with at least the amount of fuel in the tank indicated in the "returns" section. Otherwise, the lessee will have to pay the amount of the missing fuel at the current market price.
9. EXTRA CHARGES
The liquidation or total final amount of the rent is subject to the return of the vehicle in the same conditions as it was delivered and on the date, time and place agreed, so the lessee shall pay the lessor, once the vehicle has been delivered, any extra charge incurred by said lessee on the basis of these general conditions.
10. THEFTS AND LOSS OF PERSONAL BELONGINGS.
In no case will Drivalia be responsible for those personal belongings stolen, forgotten or lost inside the vehicle.
11. CHILD RESTRAINTS.
Drivalia has authorised child restraints that can be provided to customers upon request and prior to making the hire payments. The placement of these devices shall be the sole responsibility of the lessee. If they are not returned, are lost or stolen, the lessee will be charged €45 for the booster devices and/or €95 for the Baby Seat devices.
12. TERMINATION OF THE CONTRACT.
Drivalia reserves the right to terminate this contract in advance, imminently and without any sort of compensation in either of the following cases:
- When the lessee's financial ability to face the contract costs is questioned.
- When the lessee makes unauthorised use of the vehicle.
13. LAW FOR THE PROTECTION OF PERSONAL DATA
In order to comply with the Spanish Organic Law on Data Protection 15/99 of 13 December and Spanish Royal Decree 1720/2007 of 21 December, we inform you that the data you provide is stored in files owned by Drivalia and is used by our internal management. You have the right to access, modify, cancel and oppose the processing of said data. At the same time, we ask you to permit Drivalia or other collaborating entities in their commercial and financial services to use of your personal data, guaranteeing confidentiality at all times.
14. ADDITIONAL PROVISION.
It is the lessee's responsibility to carefully read this contract; any doubts or non-conformities must be expressed before accepting and/or signing the contract.
In case of breach of any of these clauses, the lessee assumes all responsibility for damages resulting from said breach with regards to both the lessor and third parties.
These conditions are complementary and apply to the SUBSCRIPTION products. The complete conditions can be found at drivalia.es/es, and take precedence over any other similar terms and conditions in our General Terms and Conditions.
Subscription is a medium-term rental product with a minimum duration of 90 days for FlexRent and 30 days for CarCloud, and is renewable every 30 days up to 1 year. If the subscription rental contract is not renewed, it will be considered terminated on the contract end date. Renewals must be made with a minimum of 24 hours notice prior to the end of the contract by contacting the Drivalia Mobility store where the car was rented.
Payment terms: The Subscription product is charged based on an automatic renewal every 30 days. The first payment is made when reserving or picking up the car. The following payments must be made every 30 days. In addition, a deposit corresponding to the amount indicated as the franchise must be left with a valid credit card (not debit) in the name of the main driver.
Included: Limited KM according to the corresponding offer. All-risk insurance with a franchise amount according to the corresponding offer, depending on the type of car chosen.
Driver’s age: The main driver and second drivers must be at least 21 years old and have 3 years of driving experience. Drivers under 25 or over 75 years old must pay a daily supplement as indicated on the “what’s included” page. For special groups with models such as Tesla, Maserati, and models such as Jeep Wrangler, Ford Mustang, etc., the minimum driver age must be 25 years old and 5 years of driving experience.
Roadside SuperCover: The customer can add the optional SuperCover service, which improves the cover against possible damage, if desired. Without Super Cover, a possible damage charge of up to €1,000 will apply.
Departures outside the national territory or the island of Mallorca (in the case of rentals at our headquarters in Palma) are not permitted without prior notice and payment of the corresponding fee. Please consult us for full details.
